The German Federal Constitutional Court pointed out in 1967 that land is not expandable. “This fact makes it impossible to leave its use to be determined by the obscure interplay of market forces and the whim of the individual. An equitable legal and social system calls instead for the public interest to play a much stronger role in the case of land than in the case of other property assets.
